尼日利亚移民总局A大区总协调人欧科罗比亚在与领区商户见面交流会上的讲话

  6月9日,驻拉各斯总领馆举办尼移民官员—领区商户见面交流会,邀请尼日利亚移民总局助理局长、A大区总协调人欧科罗比亚、移民总局拉各斯局局长阿梅德等领区主要移民官员,向领区侨团、中方机构、个体商户代表近150人全面、详细地介绍尼签证居留政策法规,并现场答疑。现欧科罗比亚先生的讲话稿登出,供参考。

  外国人在尼日利亚访问、居留和工作须知

  0.1 出于对尼日利亚华人福祉的深切关注,中华人民共和国驻拉各斯领事馆组织了本次座谈会。

  0.2 希望借此机会,在本着尼日利亚与中国两国友好关系精神的前提下,使我们在以下几个方面得到更加深远的启发。

  0.3 我首先要申明的是:所有外来移民(那些已通过尼日利亚移民法豁免的除外),无论出于何种目的,在被允许进入尼日利亚之前都要持有一本有效护照,且附有有效的尼日利亚签证/入境许可。

  0.4 尼日利亚签证/入境许可基本可分为两类:

  a) 入境签证/许可—在境外签发,并可在世界各地尼日利亚使馆或机构申请获得。

  b) 再次入境签证/许可—由尼日利亚移民局官员签发。主要用于在尼居留的外籍人员离境后的返回,而不需要去尼境外的任何尼日利亚机构申领。

  1.0 尼日利亚境外获得签证/许可的种类

  1.0.1 以下是尼日利亚境外获得签证/许可的种类,出于不同目的及用途,其中包括:

  a. 过境签证/许可(直达及非直达);

  b. 商务签证/许可;

  c. 旅游签证/许可;

  d. 外交签证/许可;

  e. 工作签证(STR);

  f. 短期工作签证/许可;

  2.0 过境签证/许可

  2.1 此类签证适于如下人群:

  a. 持有此类签证/许可的人在尼日利亚境内逗留不得超过48小时,且不允许任何形式的雇佣行为。适于持有有效机票且目的地为非尼日利亚国家的过境乘客。

  b.此类签证/许可 也适于在尼日利亚接手船只或飞机驾驶工作的海员或者飞行员。

  2.2要求:

  2.2.0 所有过境签证/许可 申请者需具备:

  a. 最少6个月有效期的有效护照;

  b. 目的地为非尼日利亚国家的有效签证;

  c. 去往该目的地国的有效机票;

  d. 足够的资金证明

  3.0 商务签证/许可

  3.1 此签证适于来尼进行商务洽谈的商人或者投资者。一般有效期为90天。持有此类签证/许可的人禁止进行任何形式的雇用行为。

  3.2 要求:

  3.2.0 所有申请者都需要向移民局外事部门提供以下材料:

  a. 在线填写申请表格;

  b. 个人资金充足的证明;

  c. 最少6个月有效期的护照;

  d. 返程机票。

  4.0 旅游签证/许可

  4.1 此类签证/许可 适于来尼旅游或探亲的人群。

  4.2 要求:

  4.2.0申领者需提供以下材料:

  a. 最少6个月有效期的护照;

  b. 如需去往其他国家,需具备目的国的有效签证;

  c. 有效的返程机票;

  d. 个人资金充足的证明;

  e. 适当的尼日利亚保险。

  4.2.1 持有旅游签证/许可的人在尼停留不得超过30天,在特殊情况下可以延期,但禁止进行任何形式的雇用行为。

  5.0 工作签证/许可 (STR)

  5.1 此签证适用于受雇于尼日利亚境内的个体,公司单位或政府的雇员。

  申领者须在尼签发机构所在国定居或居住至少6个月。

  5.2 此类签证也适于学生或者嫁入尼日利亚的女性。

  5.3 要求:

  5.3.0申领者需提供以下材料:

  a. 最少6个月有效期的护照;

  b. 任命书;

  c. 职务接受证明;

  d. 邀请函;

  e. 学历背景证明/个人简历;

  f. 申请表(移民局表格Imm22,在线填写)

  g. 如果申请者为公司首席执行官,则还需提供董事决议摘要。

  5.4 初期入境有效期为90天,并在此期间需完善工作身份的各项合法程序。

  6.0 短期工作许可(TWP)

  6.1 此类许可适于公司机构/组织邀请的专项人员予以提供专项技术服务,例如:机器设备的售后安装,维护与修理。此类许可只由总移民局长授意签发。

  6.2 要求:

  6.2.0申领者需提供以下材料:

  a. 邀请函;

  b. 确认机票;

  c. 邀请方公司执照;

  d. 申请者护照复印件。

  6.2.1 初期入境有效期为50天,任何延期需由移民局总局长批准。

  7.0 再次入境签证/许可

  7.1 此类签证适于申请期间在尼居留的外籍劳务人员。

  7.2 要求:

  7.2.0 以下为申请再入境许可程序所需材料:

  a. 再次入境许可申请表(表格IM22)。

  b.由申请者再次入境后受雇公司提供的邀请函,证明申请者将在该公司工作并履行移民责任(IR);

  c. 有效国际护照;

  d. 相关费用支付证明;

  e. 居住许可证明;

  f. 两张护照照片。

  7.3 等待工作签证审批的外籍人员再入境许可申请

  7.3.0 所有持工作签证和“等待工作签证在阿布贾审批”外籍工作人员不得向州移民局长申请超过3个月的再入境许可。

  7.3.1 对嫁入尼日利亚的女性申请再入境许可应签发为无限期。

  8.0 旅游签证/许可 的延期

  8.1 旅游许可持有者如想延期逗留可向所在地州政府机构提交申请。

  8.2 此申请需由申请者本人或者移民责任责权人书面提出申请,并需要提供以下资料:

  a. 有效的国际护照;

  b. 另一个目的地的返程机票。

  8.3 旅游许可延期申请者在满足以上条件的情况下,如果旅游签证为1个月,则可以申请不超过1个月的延期。州移民局不得向旅游签证延期申请者批准自入境日起累积逗留日超过2个月的延期。

  8.4 任何累积逗留日超过2个月的延期需由尼日利亚区域移民局总监审核。

  8.5 更长期的延期需由阿布贾移民总局长审核。

  9.0 居住许可

  9.1 所有外来人员(尼日利亚移民法案豁免的除外)都要求持有合法居留许可方可居住在尼日利亚。

  9.2 居民许可只对持有工作签证(STR)人群有效,由尼日利亚移民法案豁免或者经由移民总局长批准的除外。

  9.3 要求:

  a. 工作签证(STR)申请表格和签署同意接受移民责任(IR);

  b. 雇佣书/任命书;

  c. 职务接受证明;

  d. 支付证明(收据或者收入电子账单)

  e. 申请表(表格Imm22)并附3张登记照;

  f. 配额(QUOTA)复印件;

  g. 有效护照,工作签证,护照复印件;

  h. 专业机构的登记。

  10.0关于学生

  10.1获得入学资格的外籍人士申请合法居留需提供:

  a. 学院推荐申请表,签署同意接受移民责任。

  b. 附有STR签证/许可的护照复印件;

  c. 学费交款证明;

  d. 3张登记照片。

  11.0 嫁入尼日利亚的外籍女性

  11.1 嫁入尼日利亚的外籍女性需提交以下材料使其居留合法化:

  a. 尼日利亚丈夫的正式申请表,并签署同意接受移民责任;

  b. 妻子的正式申请表;

  c. 尼日利亚丈夫的护照(标准版)前5页的复印件;

  d. 结婚证书复印件;

  e. 移民局申请表(imm22)并附3长登记照片;

  f. 申请者(妻子)的原属国护照。

  11.2 嫁入尼日利亚的女性入境时持非STR签证的需向尼日利亚移民总局提交许可申请。

  11.3 居住许可的签发需提供资料如:居住地,居住期限,职业/职务等或者尼日利亚移民总局所要求其它任何的条款。

  11.4 嫁入尼日利亚的女性的居民许可签发是免费的。

  12.0 特殊移民

  12.1 特殊移民针对人群为娶尼日利亚籍女性为妻的外籍男士。

  12.2 特殊移民的申请需向尼日利亚国家内务部长提供以下材料:

  a. 尼日利亚妻子的正式申请信件并签署同意接受移民责任;

  b. 丈夫的正式申请信件;

  c. 妻子的护照前5页复印件;

  d. 移民局申请表(imm22)一式三份以及3张护照照片;

  e. 申请者的护照;

  f. 居民许可的付款证明。

  13.0 总结

  13.1 本场座谈会所提到的以上事项无论是内容上还是范围并非是全面的。

  13.2 我相信今天的这场座谈会对我们双方理解和尊重尼日利亚移民法律和条款都十分有益。

  “GENERAL EXPECTATIONS FROM FOREIGNERS VISITING OR RESIDING AND WORKING IN NIGERIA”

  0.0 INTRODUCTION

  0.1 This forum has been organised by the Consulate of the People’s Republic of China out of deep concern for the wellbeing of its citizens residing in Nigeria.

  0.2 We wish to use this medium to further enlighten ourselves on the following expectations in the spirit of the cordial relationship between the Federal Republic of Nigeria and People’s Republic of China.

  0.3 I will begin by stating that all immigrants except those exempted by the Nigerian Immigration Act, are required to be in possession of a valid passport endorsed with a valid Nigerian Visa /Entry Permit before they may be admitted into Nigeria for any purpose.

  0.4 A Nigerian Visa/Permit can be basically divided into two categories:

  a) Entry Visa / Permit – Those issued outside Nigerian and can be obtained from Nigerian Embassies and Missions around the world.

  b) Re – entry Visas / Permits – Those issued within Nigeria by Immigration Officers to enable mostly resident foreigners travelling out to return without going to any Nigerian mission abroad for same.

  1.1 TYPES OF NIGERIAN VISAS/PERMITS OBTAINED OUTSIDE NIGERIA

  1.1.1 The following are the types of Nigerian Visas/Entry Permits obtained outside Nigeria, for different purposes and uses. They include:

  a. Transit Visa / Permit ( Direct and Indirect)

  b. Business Visa / Permit

  c. Tourist Visa / Permit

  d. Diplomatic Visa / Permit

  e. Subject to Regularization Visa / Permit (STR)

  f. Temporary Work Permit Visa / Permit (TWP)

  2.0 TRANSIT VISA / PERMIT

  2.1 This is granted to the following persons:

  a. These category of Visas / Permits are valid for stay for up to 48hours and are not for any form of employment. It is issued to transiting passengers with confirmed tickets for onward destination to another country other than Nigeria.

  b. It is also granted to Seamen and Pilots who are joining or taking over ships or planes in Nigeria.

  2.2 REQUIREMENTS

  2.2.0 All applicants for Transit Visa/Permit are required to possess the following:

  a. Valid Passport with minimum of 6 months validity

  b. Valid Visa to onward destination outside Nigeria

  c. Confirmed airline ticket to final destination

  d. Evidence of sufficient funds.

  3.0 BUSINESS VISA / PERMIT

  3.1 This Visa/ Permit is issued to Businessmen and Investors visiting Nigeria for business discussions. It is usually valid for 90days. Any form of employment is prohibited.

  3.2 REQUIREMENTS

  3.2.0 All applicants are to present the following to the Immigration Foreign Attachees for processing:

  a. Forms to be completed by applicant on-line.

  b. Evidence of sufficient funds for personal maintenance

  c. Passport with minimum of 6 months validity

  d. Return tickets.

  4.0 TOURIST VISA / PERMIT

  4.1 These are issued to person wishing to visit Nigeria for the purpose of tourism or see family members.

  4.2 REQUIREMENTS

  4.2.0 Applicants for this facility are to produce the following documents:

  a. Valid passport with minimum of 6 months validity

  b. Valid Visa for onward destination for those proceeding to other countries.

  c. Valid airline return ticket

  d. Evidence of sufficient funds for personal maintenance

  e. Appropriate Nigerian Insurance cover.

  4.2.1 Tourist Visas/Permits are usually for stay of not more than 30days and could be extended in special circumstances. Any form of employment with this visa is prohibited.

  5.0 SUBJECT TO REGULARIZATION VISA/PERMIT (STR)

  5.1 This is issued to expatriate employees of individuals, corporate bodies or Government for the purposes of taking up employment in Nigeria. They are obtained only from Nigerian Missions in the countries where applicants are domiciled or have resided for at least 6months.

  5.2. This type of visa is also issued to student and Nigerwives.

  5.3 REQUIREMENTS

  5.3.0 Applicants for this visa/permit are produce the following:

  a. Valid passport with minimum of 6months validity,

  b. Offer of appointment

  c. Acceptance of offer

  d. Letter of invitation accepting Immigration Responsibilities,

  e. Credentials of applicant/CV

  f. Duly completer Imm 22 (on – line)

  g. For Chief Executive Officer of Corporate Organizations, the minutes of board resolution (Extract of Board Resolution) is also needed.

  5.4 Initial entry is valid for 90days within which it is expected that the process of regularization as working resident is completed.

  6 .0 TEMPORARY WORK PERMIT (TWP)

  6.1 These are issued to experts invited by Corporate Bodies/Organizations to provide specialized skilled services, such as, after sales installations, maintenance, repairs of machines and equipment. These categories of Visa/Permits are only approved by the Comptroller-General.

  6.2 REQUIREMENTS

  6.2.0 Applicants are required to present for processing:

  a. Letter of Invitation/request, accepting Immigration responsibility by inviting individuals or organizations,

  b. Confirmed airline ticket,

  c. Certificate of incorporation of inviting company,

  d. Copies of Data page of applicant’s passport.

  6.2.1 Initial entry is for 50 days and any extension can only be effected by the Comptroller-General.

  7.0 RE-ENTRY VISA/PERMIT

  7.1 Re-entry Visas/Permits are issued to applicants who are actually in Nigeria at the time of application. These applies to expatriate employees resident in Nigeria,

  7.2 REQUIREMENTS

  7.2.0 The following are the requirements for processing re-entry visa/permit; they include:

  a. Re-entry Visas/Entry Permit application (Form IM22)

  b. A letter of request from employer/Organization certifying that the applicant is returning to his/her employment and accepting Immigration responsibility (IR) on behalf of the applicant.

  c. Valid International Passport

  d. Evidence of payment of appropriate fees

  e. Evidence of residence (residence permit)

  f. Two passports-size photographs where applicable.

  7.3 APPLICATION FOR RE-ENTRY VISAS/PERMITS FOR EXPATRIATES AWAITING

  REGULARIZATION OF STAY (STR)

  7.3.0 All expatriates employees with STR visas/permits and are “awaiting regularization of stay approval from ABUJA” shall be granted re-entry visas/permits on the request for a period of not more than 3months by the State Comptrollers.

  7.3.1 All applications for re-entry visa/permit for Nigerwives shall be processed and issued for indefinite period.

  8.0 EXTENSION OF VISITING PASS

  8.1 Holders of visiting pass who desire an extension of their stay are to submit an application for such facility at the State Command within the area of their stay.

  8.2 Such requests shall be made in writing by sponsoring person or authority accepting immigration responsibility (IR); they are also to provide the following:

  a. Produce a valid International Passport, and,

  b. A return ticket to the next destination.

  8.3 Applications for extensions of Visiting Visas that satisfy the above requirements shall be approved for an extension of a period not exceeding 1month if given one month at the point of entry. Comptrollers of State Commands are to approve such extensions not exceeding a total aggregate of 2months from date of entry.

  8.4 Any request for extensions of Passes exceeding 2 months stay are to be referred to the Assistant Comptroller-General/Zonal Coordinator in charge of Zones.

  8.5 Any further extensions should be directed to the Comptroller-General in Abuja.

  9.0 POSSESSION OF A RESIDENCE PERMIT

  9.1 All immigrants, and unless exempted under the immigration Act, are required to be in possession of valid residence permits to reside in Nigeria.

  9.2 No residence permit issued to an immigrant shall be valid for entry or stay in Nigeria unless the immigrant is in possession of a valid visa/permit (STR), except if exempted by the Immigration Act or approved by the CGIS.

  9.3 REQUIREMENTS

  9.3.0 All applications for issuance of residence permits shall be addressed to the Comptroller-General and contain the following requirements:

  a. Application letter from the employer requesting regularization of stay and acceptance of Immigration responsibility (IR).

  b. Letter of appointment/employment.

  c. Letter of acceptance of appointment/employment.

  d. Evidence of payment (receipts or ‘e’-payment print-out).

  e. Completed form Imm22 with 3 passports size photographs.

  f. Copy of current Quota approval.

  g. Valid Passport with STR Visa endorsement and copies of relevant pages of the applicant’s passport.

  h. Registration with professional bodies for professionals.

  10.0 IN THE CASE OF STUDENTS

  10.1 For individual foreigners granted admission and wish to regularise their stay, these re the requirement:

  a. Formal request from the student’s Institution recommending application and accept Immigration responsibility (IR).

  b. A copy of relevant pages of student’s passport with STR Visa/Permit endorsement.

  c. Evidence of payment of School fees.

  d. Copies of relevant pages of student’s passport with STR Visa/Permit endorsement.

  e. 3 passport size photographs of applicant.

  11.0 NIGERWIVES (I.E. FOREIGN WOMEN MARRIED TO NIGERIAN MEN)

  11.1 The following requirements are to be fulfilled for regularizing Nigerwives, they include:

  a. Formal letter of request from Nigeria husband accepting Immigration responsibility (IR)

  b. Formal letter of request from the wife

  c. Photocopies of the first 5 pages of husband’s Nigerian standard passport.

  d. Copy of Marriage Certificate

  e. Duly completed form Imm22 with 3 recent passport size photographs

  f. Applicants National passport.

  11.2 Nigerwives who arrives with other visas other than an STR, such application shall be referred to the CGI for approval

  11.3 A residence permit shall be issued subject to such conditions such as, the area such person shall reside; duration of stays; occupation/profession or any provision the Comptroller-General of Immigration may direct or require to endorsed the permit.

  11.4 Facilities for Nigerwives are issued gratis.

  12.0 SPECIAL IMMIGRANT STATUS

  12.1 This special status is granted to foreigner married to Nigerian women.

  12.2 Application for special status shall be submitted to the office of the Hon. Minister for Interior with the following documents:

  a. Formal letter from Nigerian wife accepting immigration responsibility (IR).

  b. Formal letter of request from husband.

  c. Photocopies of the first 5 pages of the wife’s Nigerian national passport.

  d. Duly completed form Imm22 in triplicate, with 3 recent passport size photographs.

  e. Applicant’s national passport.

  f. Evidence of payment for residence permit.

  13.0 CONCLUSION

  13.1 The issues raised in this discourse are by no means exhaustive, both in content and scope and are meant for a target audience as we have today.

  13.2 It is my believe that this interactive session will benefit us all and improve our appreciation and understanding of Nigerian Immigration laws and practices.

  13.3 Once more I wish to thank his Excellency, the Consular-General of the People’s Republic of China and his esteemed staff for making this interactive session possible.
